Understanding Your Municipal Utility District (MUD) for First Time Home Buyers

Hello again and welcome to Houston First Time Home Buyers Edition. Today, we are speaking just a bit about Municipal Utility Districts (MUDs). MUDs are local government entities that fund infrastructure up front, providing essential services like water, sewer, conservation, irrigation, drainage, fire-fighting, solid waste (garbage) collection and disposal (including recycling activities), wastewater (sewage) treatment, recreational facilities and drainage in suburban areas, then paying those costs back over time with taxes and utility fees collected from homeowners in the district. MUD districts are usually created through "general law," by way of the Texas Commission on Environmental Quality (TCEQ) or the county commissioners court.

MUD gives the TCEQ right of supervision over all districts and authorities, however, they do not control a district's daily operations. They do however, helps district board members and their consultants to understand the varied laws and regulations under which a district must operate. State law gives districts the power to establish the authority, rights, and duties necessary to accomplish the specific purposes for which they are created. Most districts have the following powers:

  • Incur debt.

  • Levy taxes.

  • Charge for services and adopt rules for those services.

  • Enter contracts.

  • Obtain easements.

  • Condemn property.

Your MUD payment is a part of your property taxes. Texas property taxes are made up of county, school district, city, community college/hospital and of course, MUD tax. School tax is usually the largest amount. Buying in a MUD community is extremely beneficial, however, like everything else, it does come with a cost.
