What is an Affidavit of Heirship?

Hello and welcome to Houston First Time Home Buyers Edition. An affidavit of heirship is typically a 5 page document that can be used to identify heirs, that may be entitled to any property left behind, when the deceased leave no will and a limited estate.
Heirs typically mean children, grandchildren, or parents, but not spouses. To complete the Affidavit, you will need to provide information that include but not limited to:
Name
Address
Relationship
When the relationship begin
Date of birth
Place of birth
Date of death
Place of death
Age of death
Cause of death
Address at the time of death
Marriage information
Name, date of birth, address, children, and spouse of all living children
Known property owned by the deceased.
Once completed, the affidavit of heirship will need witnesses that knew the deceased for at least (20) years, and will not benefit from the sale of the property in any way.
